A state Court of Appeal ruled last month that Polanski could not send his attorneys to court in California to make that argument without Polanski appearing in court, an action that would likely result in his jailing. This ruling in effect quashed the director's attempt for him to be sentenced in absentia and dealt a heavy blow to him.
The Swiss government is still considering whether to go ahead with the extradition.
The fugitive director hoped that the Swiss authorities would recognize that "there are no grounds for extradition, and that I shall be able to find peace, be reunited with my family, and live in freedom in my native land."
