酒后驾车加大处罚力度
Starting from May 1st, the law on drunk driving will be changed. Drunk driving will now be considered to be dangerous driving, regardless of whether it is accompanied by another traffic offence. My colleague Wang Tao explains the new regulations on drunk driving.

Chen Jia was charged with endangering public security by dangerous methods. According to current Chinese criminal law, the heaviest penalty for a traffic offence is seven years of imprisonment, while endangering public security can carry a life sentence. Prof. Han Yusheng, Renmin Univ. of China, Beijing, said, "He knew that he was drunk. But he was driving, so his drunkenness actually put other people's lives at risk. Even with the possibility of these consequences, he didn't take any precautions. He caused two deaths and two injuries. This is beyond a traffic offence, and can be defined as endangering public security by dangerous methods."
北京中国人民大学Han Yusheng教授说:“他知道他喝醉了。但是还开车,所以他的酒醉实际上使别人的生命处于危险之中。尽管知道有可能造成这些后果,他并没有采取任何预防措施。他造成两死两伤。这不仅违反了交通规章,而且可以认为使用威胁方法危害公共安全。”
Statistics show that between 2006 and 2010, drunk driving has claimed the lives of more than 3500 people every year, and injured more than 9000. Many people from all walks of life have been calling for heavier sentencing to be imposed. The Third Amendment to the Criminal Law of the People's Republic of China meets the call of the society.
数据显示,从2006年到2010年,酒后驾车每年造成超过3500人死亡,超过9000人受伤。许多各业人士呼吁实行更重的刑罚。《中华人民共和国刑法修正案(三)》满足社会的呼声。
Prof. Han Yusheng, Renmin Univ. of China, Beijing, said, "Currently, people are only punished if a traffic offence occurs. That means drunk driving will go unpunished if it does not cause traffic offences. This is the problem the amendment to the criminal law aims to tackle. According to the new amendment, drunk driving, with or without traffic offences, will be punished."
北京中国人民大学Han Yusheng教授说:“如今,只有当人们违反交通规则时才会受到处罚。那即是说如果酒后驾车没有引起交通违规,他就不会受到处罚。这就是刑法修正案所要解决的问题。根据新的修正案,无论有没有造成交通违规,酒后驾车都要受到处罚。”
The previous lenient sentence for drunk driving has proven ineffective, as drivers will often take the chance, believing they will not be caught. Under the new amendment, drunk drivers will be viewed as posing a hazard, inviting a heavier sentence.
先前对酒后驾车的仁慈判决已经证明无效,因为司机们经常会冒险,觉得他们不会被捉到。根据新的修正案,酒后驾车将被视为构成危险,引起更严重的判决。
