iPad商标纠纷移至上海

The iPad trademark dispute moved to Shanghai yesterday (Wednesday). A court there will deliberate a request by troubled technology company, Proview, to stop the sale of iPads across China. Some are calling the battle "pre-settlement brinkmanship", but a lot is at stake for both companies.
iPad商标纠纷昨天（星期三）移交到上海。那里的一间法院将考虑麻烦缠身的科技公司唯冠提出的在中国停售iPad的请求。一些人将这场战斗称为“和解前的边缘政策”，但是很多人都觉得这两间公司危如累卵。

The battle over the iPad is heating up. During a hearing that lasted four hours, Shenzhen Proview argued that Apple should stop selling its tablet in the mainland on trademark grounds. Proview, hammered by the financial crisis and facing a potential delisting from the Hong Kong exchange, has a lot at stake.
关于iPad的这场战争激烈起来。在持续四个小时的一场听证会期间，深圳唯冠争辩称，因为商标的原因，苹果应该在内地停售其平板电脑。受金融危机重创并可能面临从香港交易所除名的唯冠濒临险境。

But Apple has a lot at stake, too. China is one of its biggest markets, second only to the United States. The tech giant is looking to stop the case, insisting it bought the rights for the iPad name from a Proview affiliate in Taiwan back in 2009.
但是，苹果也同样濒临险境。中国是其最大的市场之一，仅次于美国。这个科技巨头希望能停止该诉讼案，坚称早在2009年就在唯冠在台湾的一间附属公司那里购买iPad名字的商标权。

Liu Chunquan, the I.P. lawyer of Polwa & Co., said:" Apple knows this very well, so it uses a small company to buy this trademark. It is a very common practice in China, we also get this kind of business, because a lot of Chinese investors are registering a lot of domains and trademarks, and waiting for the big clients to buy them. So my opinion is that this is not fraud. This is not business fraud, this is like the Chinese saying, business is like a battle, and it's like a war."
Polwa & Co.的I.P.律师刘春泉称：“苹果非常清楚这一点，所以它用一间小公司去买这个商标。这在中国是非常常见的一种做法，我们也接过此类的业务，因为很多中国投资者在很多领域和商标都注册了，等待大客户来买。所以我的观点是这并不是欺诈。这不是商业欺诈，这正如中国人说的，商场似战场，这像是一场战争。”

But despite rising tensions, many expect the two sides to reach a settlement, rather than continue to battle it out in the courts.
虽然紧张状态提升，许多人预测双方将达成协议，而不是对簿公堂。

Liu also said:" I think the solution; the final solution may probably be that Apple reaches an agreement with this Proview Company outside of the court. That is probably the result, because that is also the result of many international business disputes."

If Apple loses this case, its iPad could be taken off all the shelves in the mainland.
