中国拟立法规定电商平台对假冒产品负责

China is preparing to pass a wide-ranging law that would hold ecommerce platforms run by Alibaba, JD.com and Tencent liable for fraudulent goods sold by vendors on their sites.

中国正准备通过一部适用范围较广的法律,迫使由京东和腾讯等运营的电商平台对卖家在其网站上出售的假冒商品负责。

The draft legislation, to be reviewed this week by China’s legislature body, marks a shift in the approach regulators have taken in managing the country’s $1trillion ecommerce market, which has been plagued by the sale of fake or substandard products.

本周将由中国全国人大审议的立法草案,标志着监管机构管理中国1万亿美元电子商务市场方式的转变,这个市场一直受到假冒或劣质产品销售的困扰。

“Now [the law] seems to have expanded such that if there’s a problem with the product, or if it is fraudulent, platforms like Alibaba and JD.com become liable.”

Platforms such as Alibaba’s Taobao or Tmall currently have a notice and takedown policy for merchants that violate consumer rights or sell knock-offs. Buyers need to notify the platform of a fraudulent product, the company will investigate and take it down if needed.

阿里巴巴旗下的淘宝或天猫等平台目前针对侵犯消费者权益或销售假冒商品的商家实行通知和删除政策。买家需要向平台举报一款假冒商品,阿里巴巴将展开调查,并在必要时将其下架。

By extending legal responsibility to the platform, Chinese regulators are hoping to close a loophole that has made preventing the sale of fraudulent goods a cat-and-mouse game, said lawyer.

律师们表示,通过将法律责任扩展至平台,监管机构希望堵住一个漏洞,此前这个漏洞把阻止假冒伪劣产品销售搞成了一场猫捉老鼠的游戏。

“The target would be the bigger platforms. Actually the draft law also looks at relieving the obligations on some of the smaller vendors,” said Eugene Low, a Hong Kong lawyer.
